Malpractice suits don't exist.

It's a big right wing talking point.that junk lawsuits drive up medical cost. Most legitimate malpractive cases are never brought to trial. No one can afford a lawyer & lawyers only take on catastrophic cases on a contingency basis. Death, brain injury, blindness, & unnecessary loss of limb. To add to the equation, you need a doctor or dentist to commit himself on paper to determine gross negligence. They fear defamation & don't care.

Statute of limitations are such that you can't evaluate the extent of the harm, & with it taking 4-5 months to even get appointments for evaluation?

Just one of many letters of rejection that are going to prove a death sentence for me.(literally I'm going to have to take my life) as my teeth are ruined, presently too much discomfort, & I won't be part of that population wearing dentures.

Dear Mr. Tomaselli:

Thank you for contacting my office with regards to a potential dental malpractice case.

Unfortunately, based in part on my busy work load at this time, I have decided that I shall be unable to take on your legal matter. Therefore, I must respectfully decline representation. All information you provided to my office shall of course remain confidential. There may be a valid claim, so please note that another law firm/attorney may decide to pursue the matter on your behalf.

While I offer no specific opinion about the statute of limitations, please be aware that there are strict and complex time restrictions imposed by law (statute of limitations) that require a dental malpractice lawsuit be filed in within a set period of time. Failure to have a lawsuit on file within the time required by law would very likely result in a loss of any legal rights. Statute of limitations issues may be quite complicated and varied. Even a short delay in obtaining representation and/or formally pursuing your legal claim in court could jeopardize any rights to pursue the matter.

Using peer review or filing a complaint with the California Dental Board will not protect the statute of limitations from expiring.

Therefore, if you wish to pursue the claim, I suggest that you not delay in consulting with another law firm/attorney.

You may consider contacting the following attorneys/law firms that also handle dental malpractice matters.
